Partner Brett E. Feldman and associate Chase J. Ulisse prevailed before the Superior Court of New Jersey – Atlantic Division in the matter of Cesar Infante v. Boardwalk Regency, LLC (ATL-L-1163-23). The Plaintiff alleged to have fallen in a bathroom at the subject premises due to a claimed hazardous condition that was present in the restroom. Brett moved for Summary Judgment and appeared before the Court for oral argument to assert his client’s position that the claims were incredulous due to the Plaintiff’s lack of evidence to show a dangerous condition existed as well as the Defendant’s actual or constructive notice of the alleged condition. The trial judge sided with Brett’s dispositive motion and granted Summary Judgment with prejudice.
