Karen A. Mascioli is a Partner at Sweeney & Sheehan, where she focuses her practice on complex construction defect litigation, bodily injury claims, and general liability matters. With a proven track record of success, Karen has achieved early dismissals in numerous cases and has skillfully litigated complex binding arbitration matters to verdict. She represents clients at both the trial and appellate levels in New Jersey, as well as in state and federal courts in Pennsylvania.
Karen’s path to the legal profession reflects her remarkable dedication and perseverance. While working full-time and raising a family, she attended night classes to earn her associate, bachelor, and ultimately, her law degree. Her commitment to academic excellence and determination in pursuing a legal career were honored by the New Jersey Senate through a formal Resolution.
After earning her law degree, Karen served a one-year judicial clerkship with the Honorable Mary Colalillo in Camden, New Jersey. She then joined a defense firm where she represented clients in matters involving construction defects, transportation, and bodily injury claims including motor vehicle accident and premises liability.
Karen is an active member of the New Jersey State Bar Association, the Camden County Bar Association, and the Claims and Litigation Management Alliance.
Outside of her legal work, Karen enjoys performing volunteer work through local organizations, traveling, and spending quality time with her family and friends. She is an avid sportswoman who enjoys archery, fishing, off-road quad riding, and boating.
- Successfully moved to dismiss a plaintiff’s construction defect case for failure to prove damages in the Superior Court of New Jersey, Law Division – Bergen County. The Plaintiffs alleged that defects in the general contractor and other contractors’ new home construction work caused multi-million-dollar damage including costs of repair and claimed entitlement to treble damages and reimbursement of counsel fees pursuant to the Consumer Fraud Act. Karen moved to bar plaintiffs’ expert testimony finding that the plaintiffs’ expert’s damages testimony constituted a net opinion and dismissed with prejudice the plaintiffs’ complaint for failure to prove damages.
- Obtained voluntary dismissal in several construction defect matters filed in the Superior Court of New Jersey, where aggressive discovery established sufficient evidence to satisfy opposing counsel that no viable theory of liability existed against her clients.
- Obtained summary judgment for floor installer in a contractual defense and indemnity case filed after binding arbitration in the underlying construction defect matter based upon the Entire Controversy Doctrine in the Superior Court of New Jersey: Ocean County.
- Obtained voluntary dismissal in premises liability – security case for bar and restaurant owner where patron alleged injuries in a physical altercation at establishment in the Superior Court of New Jersey: Burlington County.
- Obtained summary judgment for a driver in a motor vehicle – bicyclist dart out personal injury case where minor plaintiff sustained a broken leg in the Superior Court of New Jersey: Passaic County.
