New Jersey Appellate Division Win for Thakkar

Sweeney & Sheehan partner Neal A. Thakkar recently prevailed before the New Jersey Appellate Division in the matter of Soiro v. Family Dollar, A-907-24 (App. Div. Dec. 3, 2025). The plaintiff claimed that she sustained permanent injuries after she slipped and fell due to a clothes hanger on the floor of the defendant’s store. Neal moved for summary judgment, arguing that the plaintiff could not prove actual or constructive notice and that, based on a 1951 Appellate Division case, the mode of operation exception did not apply. The trial judge granted summary judgment and denied plaintiff’s motion for reconsideration. Plaintiff then appealed, and the Appellate Division affirmed the orders under review, agreeing with Neal’s arguments as made to both the trial and appellate court.
