Susan Toth and Nicole Cramer recently obtained summary judgment in the Philadelphia Court of Common Pleas on behalf of the firm’s client, a designer and manufacturer of fire sprinkler heads. The case arose from the alleged sudden discharge of a fire suppression system in a residential condominium building in Philadelphia. Our client supplied the sprinkler heads for the building’s fire suppression system. Plaintiffs alleged claims of strict liability and negligence against our client. In moving the Court for summary judgment, Susan and Nicole argued discovery had failed to produce any evidence of a design or manufacturing defect, and plaintiffs failed to offer any expert opinion that a defect in the sprinkler head was a cause of the fire suppression system discharge. In granting summary judgment and dismissing all claims against our client with prejudice, the Court noted “there was a dearth of causation evidence presented in the record stemming from any design flaw or manufacturing defect in the subject sprinkler head.”
