New Jersey managing partner Andy Siegeltuch recently obtained partial summary judgment for a carrier in a first-party case where plaintiffs alleged that, due to the carrier’s failure to pay benefits sufficient to restore their property following a loss, mold accumulated in their home causing bodily injuries to the homeowners and their children.

In addition to seeking recovery for bodily injuries, the plaintiffs also alleged bad faith and sought punitive damages. Following argument on motion, the Superior Court granted summary judgment in favor of the carrier on all of these claims.
