M. Susan Toth concentrates her practice on product liability, construction, and trucking matters. She has substantial experience representing clients throughout all phases of litigation before state and federal courts, arbitration panels, and administrative agencies. For over a decade she has successfully defended domestic and international manufacturers and distributors in complex products liability matters involving a wide range of products, including industrial machinery, construction equipment, infant products, and athletic equipment. Her experience includes class action and mass tort cases. She has represented commercial motor carriers against catastrophic injury claims and alleged FMCSA, FHWA, and DOT violations. Susan also defends general and sub-contractors in catastrophic injury and breach of contract cases.
While Susan has extensive experience with all phases of litigation, she seeks creative resolutions to disputes in an effort to minimize her client’s exposure to protracted litigation. She has also counseled clients on risk-avoidance measures, product recalls, and coordinated responses to governmental investigations.
Susan’s commitment to community engagement and pro bono work is evident by her service as a past Board Member of the Legal Clinic for the Disabled, where she served as Chair of the Human Resources Committee and was a member of the Strategic Planning Committee, and her representation of children in the foster care system as a volunteer attorney with the Support Center for Child Advocates. She currently serves as a member of her law school’s Alumni Council.
Susan earned her Juris Doctor, with a Certificate in Comparative and International Law, from The Catholic University of America Columbus School of Law, where she was selected as Chancellor of the Moot Court Association. While in law school, Susan was a law clerk for the Montgomery County Maryland State’s Attorney’s Office Major Felony Team. Susan also completed graduate legal studies in international human rights law, at The Graduate Institute of International and Development Studies, Geneva, Switzerland. She received her Bachelor of Arts from Villanova University, where she was a member of the Honors Program. Susan is admitted to practice before the Pennsylvania and New Jersey bars, the United States District Court for the Eastern District of Pennsylvania, the United States District Court for the Middle District of Pennsylvania, and the United States District Court for the District of New Jersey.
